Trust Administration is not simply a family matter.  If you are serving as Trustee, you have many responsibilities and legal duties to the beneficiaries of the Trust.  Trust Law has become more complex due to the dramatic increase in Trust litigation.  Most Revocable Living Trusts allow the Trustee to hire and pay for an attorney using Trust assets.  It is critical that the Trustee retain an Attorney to ensure they are protected.

We walk the Trustee through the Trust Administration process, including:

  • Prepare the required Trustee Notification and serve copies of the Trust on all beneficiaries and heirs-at-law;
  • Assist the Trustee in collecting and marshaling of Trust assets;
  • Assist the Trustee in the sale of real property, including review of Escrow Instructions and notices to Trust beneficiaries of any pending sale;
  • Obtain date-of-death values for each Trust asset;
  • Prepare an accurate accounting of all financial transactions involving the Trust in compliance with the California Probate Code; and
  • Obtain Releases from each beneficiary to ensure the Trustee is not sued after distribution of the Trust assets.
